Persons affected by Commission action on certain items on this agenda may be allowed to address the Commission, either informally or by oral argument, when those items are taken up for discussion at this conference. These items are designated by double asterisks (**) next to the item number.

To participate informally, affected persons need only appear at the conference and request the opportunity to address the Commission on an item listed on the agenda. Issue 1: 

 Should the Commission approve the proposed Amended 2025 Territorial Agreement between Talquin and Quincy, dated September 5 November 14, 2025?

Recommendation: 

 Yes, the Commission should approve the proposed Amended 2025 Territorial Agreement between Talquin and Quincy in Gadsden County, as consistent with the standards for approval set forth in  Rule 25-6.0440(2), Florida Administrative Code (F.A.C.). The proposed Amended 2025 Territorial Agreement, if approved, adjusts the territorial boundary line set forth in the utilities’ 1995 Territorial Agreement, allowing the joint petitioners to accommodate future loads in a more efficient and cost-effective manner. Also, the terms of the proposed Amended 2025 Territorial Agreement would permit the joint petitioners to avoid unnecessary duplication of transmission and distribution facilities as well as better serve the future needs of their respective customers.

Issue 2: 

 Should this docket be closed?

Recommendation: 

 Yes. If no protest is filed by a person whose substantial interests are affected within 21 days of the issuance of the Order, this docket should be closed upon the issuance of a Consummating Order.

Issue 1: 

 Which index should be used to determine price level adjustments?

Recommendation: 

 The Gross Domestic Product Implicit Price Deflator Index is recommended for use in calculating price level adjustments. Staff recommends calculating the 2026 Price Index by using a fiscal year, four quarter comparison of the Implicit Price Deflator Index ending with the second quarter of 2025.

Issue 2: 

 What rate should be used by water and wastewater utilities for the 2026 Price Index?

Recommendation: 

 The 2026 Price Index for water and wastewater utilities should be 2.46 percent.

Issue 3: 

 How should water and wastewater utilities be informed of the indexing requirements?

Recommendation: 

 After the expiration of the Proposed Agency Action (PAA) protest period, the Division of Accounting and Finance should send each regulated water and wastewater utility a copy of the PAA Order establishing the index containing the information presented in Attachment 1 of staff’s memorandum dated November 18, 2025. A cover letter from the Director of the Division of Accounting and Finance should be included with the order (Attachment 2 of staff’s memorandum dated November 18, 2025). The entire package should also be made available on the Commission’s website.

Issue 4: 

 Should this docket be closed?

Recommendation: 

 No. Upon expiration of the 14-day protest period, if a timely protest is not received the decision should become final and effective upon the issuance of a Consummating Order. Any party filing a protest should be required to prefile testimony with the protest. However, this docket should remain open through the end of the year and be closed upon the establishment of the new docket in January 2026.

Recommendation: 

 Yes. The appropriate AFUDC rate for SWS is 7.56 percent based on a 12-month average capital structure for the period ended December 31, 2024.

Issue 2: 

 What is the appropriate monthly compounding rate to achieve SWS’s requested annual AFUDC rate of 7.56 percent for the period January 1, 2025, through May 31, 2025?

Recommendation: 

 The appropriate compounding rate to achieve an annual AFUDC rate of 7.56 percent is 0.609170 percent.

Issue 3: 

 Should the Commission approve SWS’s requested effective date of January 1, 2025, through May 31, 2025, for implementing the AFUDC rate of 7.56 percent?

Recommendation: 

 Yes. The AFUDC rate of 7.56 percent should be effective January 1, 2025, through May 31, 2025, for all purposes.

Issue 4: 

 Should the Commission approve SWS’s request to increase its AFUDC rate from 7.56 percent to 8.03 percent, effective June 1, 2025?

Recommendation: 

 Yes. The appropriate AFUDC rate for SWS is 8.03 percent based on a 12-month average capital structure for the period ended May 31, 2025.

Issue 5: 

 What is the appropriate monthly compounding rate to achieve SWS’s requested annual AFUDC rate of 8.03 percent, effective June 1, 2025?

Recommendation: 

 The appropriate compounding rate to achieve an annual AFUDC rate of 8.03 percent is 0.645732 percent.

Issue 6: 

 Should the Commission approve SWS’s requested effective date of June 1, 2025, for implementing the AFUDC rate of 8.03 percent?

Recommendation: 

 Yes. The AFUDC rate of 8.03 percent should be effective June 1, 2025, for all purposes.

Recommendation: 

 Yes, the Commission should approve Peoples’ proposed CI/BSR Rider surcharges to be effective for the first billing cycle of January through the last billing cycle of December 2026. Staff has reviewed Peoples’ filings and supporting documentation and believes that the calculations are consistent with the methodology approved in the 2012 Order and are reasonable and accurate.

Recommendation: 

 Yes. If Issue 1 is approved and a protest is filed within 21 days of the issuance of the order, the tariff should remain in effect, with any revenues held subject to refund, pending resolution of the protest.  Should the Commission approve FPUC's 2026 Gas Utility Access and Replacement Directive (GUARD) cost recovery factors and associated Third Revised Sheet No. 7.403 for the period January to December 2026?

Recommendation: 

 Yes. The Commission should approve FPUC's 2026 GUARD cost recovery factors and associated Third Revised Sheet No. 7.403, included in Attachment B of staff’s memorandum dated November 18, 2025, to be effective for the first billing cycle of January 2026 through the last billing cycle of December 2026. The Commission should also approve FPUC’s request to provide six months of actual and six months of estimated data in its actual/estimated true-up filings. The GUARD surcharge would allow FPUC to replace problematic pipes and facilities and relocate certain facilities located in rear easements to the front easements, and recover the project costs on an expedited basis.

Recommendation: 

 Yes. The Commission should approve FCG’s proposed SAFE tariff for the period January through December 2026. After reviewing FCG’s filings and supporting documentation, the calculations of the 2026 SAFE factors appear consistent with the methodology approved in the 2015 Order and are reasonable and accurate.

Issue 2: 

 Should this docket be closed?

Recommendation: 

 Yes. If Issue 1 is approved and a protest is filed within 21 days of the issuance of the order, the tariffs should remain in effect, with any revenues held subject to refund, pending resolution of the protest.  If no timely protest is filed, this docket should be closed upon the issuance of a consummating order.
